Employer / C/TPA explainer

DOT / 49 CFR Part 40

You stay the employer. We operate the testing program as a C/TPA-style service agent — order → collection → SAMHSA lab → MRO → report. Similar in role to a TPA. LTS is not eScreen.

Not legal advice. Under §40.11, the employer remains responsible even with a C/TPA.

Roles

You stay the employer

This page is for employers using a C/TPA-style program — not a CDL school onboarding narrative.

You (employer)

  • Remain responsible under Part 40 (§40.11)
  • Set policy, hire/fire, and program decisions
  • Own FCRA and employment decisions
  • Clearinghouse employer duties stay yours

LTS (C/TPA-style service agent)

  • Operate the testing program workflow
  • Order → collection → SAMHSA lab → MRO → report
  • Coordinate collection sites and lab routing
  • Deliver results to your employer account
